Daisy Kroon Terms and conditions 

 The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as ”you”) with Daisy Kroon, hereinafter referred to as “Daisy Kroon", “SDK”, ”us ” or ”we”, at the Daisy Kroon website, mobile website, or telephone (jointly referred to as ”daisykroon.com”). 

We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on daisykroon.com at the time you place your order. 

By using daisykroon.com com and/or placing an order, you agree to be bound by the terms and conditions set out herein (the ”Terms”). Please make sure you have read and understood the Terms before placing your order. 

Daisy Kroon want to provide the best possible online experience. To make this possible we need to ensure that our services runs like a clockwork. You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the daisykroon.com site, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these terms and conditions.

  1. Products and pricing 

The prices displayed at daisykroon.com include the statutory Value Added Tax but does not include a delivery charge. 

The inclusion of any products or services on daisykroon.com at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time. Therefore we can not guarantee that all items included in the SDK web shop are in stock at the time of your order. In the event that an item is unavailable, SDK will contact you shortly by phone or by e-mail. 

Although SDK strives to display the correct texts, images and pricing on the site, errors may occur. If you have been charged the wrong amount in the web shop, SDK will give you the option of placing a new order with the correct price or by cancelling your order. SDK however, reserves the right to cancel any order prior to dispatch should we find that the price is incorrect. In such case we will notify you by email. If we are unable to contact you, your order will be automatically cancelled. 
Part of the services mediated through the site are maintained by outside organizations (for example POST NL). In situations where SDK acts as agent for such services, we cannot be held responsible for any errors resulting from their activities.  

  1. Colors

At Daisy Kroon we make all reasonable efforts to accurately display the attributes of our products, including composition and colours.The colour you see will depend on your computer system and we cannot guarantee that your computer will accurately display such colours.

  1. Availability

At the Daisy Kroon webshop there are several options in terms of our availability.

In stock; this piece can be purchased right away
Sold out; the product is no longer available
Made to order; the requested piece is out of stock at the moment, but you could still place an order for this item: we will produce this item on request especially for you. This could take up to maximum 4 weeks and there is no refund possible.
The ‘made to order’ option also allows you to order a garment made to measure. Please send us an email for more information.  

Our clothing is made by hand and the garments offered online are also available in our store, which means that our stock is dynamic. This sometimes results in pieces not being directly available for purchase.
In case the fabric displayed online or of your liking is not available anymore we will suggest a substitute and offer you to send you a sample. We cannot always guarantee the availability of all fabrics in all colours, but will always notify you.

  1. Delivery and shipping

Daisy Kroon exercises the utmost diligence in accepting and processing orders and will endeavour to deliver your order in accordance with your selected delivery option. 

Before you place your order, you will be informed of the expected delivery details. Once you have placed your order you will receive an email confirmation with your expected delivery details. Shipping costs are standard shipping costs (POST NL rates apply).

You can always pick up orders in our store in Rotterdam, free of charge. Please check our shipping and returns policy for more details.

Once you have placed your order, if you have supplied us with your email address, you will receive an email confirmation. If for any reason we are unable to fulfil your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary we will notify you and ask you to contact Daisy Kroon Customer Service who will settle the refund. 

  1. Returns

If for any reason you are not happy with your purchase or you wish to cancel your order, please provide us with notice stating the reason for doing so in writing via email to info@daisykroon.com and return the item(s) to us within the 14-day period.

Daisy Kroon guarantees a full refund or compensation as a voucher for any returned items provided that all items are returned in the same condition they were in upon your receipt. This means the items should not have been damaged, soiled, washed, altered or worn, that any labels or tags should be intact and (insofar as possible) is in the original and undamaged packaging.

If you wish to exchange your items can send an email to info@daisykroon.com and ask for a compensation as a voucher, we will then create a voucher with a value of the goods returned.  

In the case you want a refund, SDK will refund the purchase price of the product as quickly as possible to the account used to purchase the order. 

You can return items by going to our store or return by post with the postal company of your choice (return shipping costs are not refunded).

  1. Copyright

The content of the web shop is copyright-protected and is the property of Studio Daisy Kroon. All intellectual property rights to the content of the web shop belong to SDK. It is allowed to download, print, copy and blog about the material from the website for your own personal purposes, however not for commercial purposes. This presumes that the material is not changed and that all intellectual property rights remain It is allowed to link to the website and shop, but not without using Daisy Kroon symbols or trademarks.

  1. Discount & offers

Offer or Coupon can not be combined with any other offers. This means that you cannot combine the coupon code with any other discounts, such as a personal discount with ‘free shipping’ discount.  

  1. Payment methods

You can pay for your goods in various ways: Creditcard, Ideal or Paypal. Payments are made in advance and are processed by Mollie Payments, Stripe or Paypal depending on your preferred way of payment.

SDK reserves the right to check the validity of your credit/payment card or Paypal account, its credit status in relation to the order value and whether the address data of the purchaser is correct. We may refuse orders depending on the result of these checks. 

By using a bank card/credit card for payment via Mollie or Stripe payments you confirm that the user card is yours. SDK is not liable for abuse of a bank card and/or credit card and for abuse of information by others.

  1. Privacy Policy and Personal Data  

Studio Daisy Kroon is responsible under the Dutch Personal Data Act for the processing of the personal data which you as a customer provide us with. The aim of the processing and registration of your data is sole to prepare, process and complete your order, to improve our customer service and for marketing purposes, SDK will not transfer your personal data to any third party for the purpose of marketing. 

Data which is transferred to a third party is solely used in for the benefit of the customer, for example shipment of the order.  

You may at any time write to SDK and withdraw your consent to letting SDK use your data for marketing purposes (for example by sending you newsletters, offers and such). If you wish to change your registered personal data or if you have any questions on which personal data we have registered please contact us: info@studiodaisykroon.com  

All customers paying by card are subject to validation checks. SDK reserves the right to delay any order if fraud is suspected. For security reasons, we do not store any payment information in our database. 

  1. Violation of rules

SDK reserves the right to seek all solutions available at law and in equity for violations of these Terms and Conditions, including the right to block access to the site. 

  1. governing law

These terms of use are complied in accordance with Dutch law and the Dutch courts will have exclusive jurisdiction for any dispute under this agreement.  
 
The laws of your country may differ from the Netherlands and there may be additional legal requirements to use this website. You must comply with all applicable local and international laws and regulations regarding your use of our website.
